Mighty Direct Notice for Parents or Legal Guardians

My Lemonade Stand, PBC d/b/a Mighty (“Mighty,” "we,” “us,” or“ our") is the operator of the Mighty service available at www.mighty.business and other associated websites and mobile applications, which provide an interactive, e-commerce platform through which kids can be their own CEOs and sell products (collectively the "Services").   As part of your child’s participation in the Services, we must inform you of our privacy practices and seek your consent to your child’s use of the Services.

Please read this Direct Notice to learn more about the personal information (as defined by the U.S. Children’s Online Privacy Protection Act (“COPPA”) we collect from your child, and how we use and share it.  If you consent to your child’s participation in the Services, please use a valid payment account to pay the applicable fee indicated on the Services to launch your child’s shop.  If you do not agree to your child’s participation in the Services, or to any of our privacy policies or terms, please do not allow your child to participate in the Services.

By providing your consent for your child to use the Services as discussed below, you also agree that your child’s use is subject to the Mighty Terms of Service.

What Information Do We Collect from Your child?

We collect personal information from your child when he or she uses the Services. The information we collect from children includes:


  • Registration and account information, including:  age, name, email address, password and username, and, in accordance with applicable legal requirements, your child’s or your phone number.
  • Profile and shop information, which is visible to other users and to individuals with whom your child shares shop information, including: cover image, CEO bio, shop bio, and your child’s descriptions of the products he or she is selling.  Your child can also submit feedback to us or other users about his or her shop and different products, and will have the ability to participate in forums and group features.
  • Activity and usage data.  We, and our third-party service providers collect certain information automatically as your child uses the Services through the use of cookies and other online tools in order to, among other things, provide and improve the Services, analyze use, personalize content, and secure and troubleshoot the Services. This information includes:

    o  IP address, device type and version, information about that device’s operating system, and device identifier
    o  information about how your child uses the Services, including content viewed or posted, products viewed or selected for sale, and user interactions
  • Potential Buyer Contact Information.  Your child can provide email addresses of potential buyers so that your child can send communications regarding your child’s shop
  • Customer support inquiries.  If your child contacts us for customer support, we will collect your child’s basic contact information, and information about the request and its resolution.

How and with Whom Do We Share Information from Your child?

Please note that we do not share or disclose your child’s information for marketing purposes. Because Mighty is designed to be an interactive e-commerce platform through which children can sell products and interact with other users, your child's shop information, profile, and forum and group postings are public and can be seen by other users, visitors to the Services, and contacts provided by your child.  We also may share your child’s personal information in the following circumstances:

  • With our service providers so they can perform services on our behalf (e.g., hosting providers, analytics providers)
  • As permitted or required by law, including in response to a court order or a subpoena
  • To protect the safety of a child, to prevent a crime, or to facilitate a public safety investigation
  • To take precautions against liability
  • To protect the security or integrity of our Services
  • If we are involved in a merger, acquisition, or asset sale, a child’s information may be among the information shared, and in such a situation, we will comply with applicable legal requirements

We may share aggregated, de-identified information relating to activity on the Services with third parties or the general public. For example, this may include the provision of reports regarding child engagement with the Services to improve the Services, or analysis of use of the Services or its features.  Such aggregated, de-identified data will not contain any personal information from your child and can be freely shared in our discretion.

What Parental Controls Do We Offer?

Parents or guardians may contact us using the contact information below to access or delete their child’s information, or request that we no longer collect, use, or maintain their child’s information.

How Can You Provide Your Consent?

For your child to participate in the Services, you must pay the applicable fee indicated on the Services to launch the shop through the use of a valid payment account number and review and agree to our COPPA Notice, privacy policies, and Terms of Service. Your child will then be able to proceed with registering and setting up their account.
